There is a common misconception that an appeal is a new trial. This is not true. If you have a case on appeal, it usually means that you lost your case at trial and are attempting to have the decision overturned by a higher court. In an appeal, the court does not hear evidence. Instead, only arguments on legal points where the trial judge in the original case has ruled are allowed.

Remember: Appellate courts do not decide guilt or innocence
When you appeal a court decision in Virginia, you are asking the Virginia appeals court to decide whether the original trial judge made a mistake, entitling you to a new trial. Examples of this type of mistake include (but are not limited to):
